Refiling Required for Certain Incorrect Type of Insurance (TOI) and/or Filing Type
The Compact often receives filings that reflect incorrect TOIs or Filing Type. When setting up your Compact SERFF filing, it is helpful to consult the "Compact Type of Insurance" reference document that can be accessed on the Filing Reference Materials section of the Industry Resources page of the Compact website. For your convenience, you can access the TOI reference document here.
"Close enough" is not sufficient for the TOIs that involve state opt-outs from the Uniform Standards. Please take care to accurately set the TOI and Filing Type applicable for your filing. As cited below, using the incorrect TOI or Filing Type for the following filings will require a refiling using the correct information.
- Long-Term Care filings are required to use the LTC TOI. Combination product filings that contain a LTC component are also required to use the LTC TOI. Please review FIN 2017-2 for further filing guidance.
- Individual Disability Income filings are required to use the DI TOI. Combination product filings that contain a DI component are also required to use the DI TOI. Please review FIN 2018-1 for further filing guidance.
- Index-Linked Variable Annuity (ILVA) filings are required to use TOI "A02.1I Individual Annuities-Deferred Non-Variable and Variable". Please review Weekly Tip dated November 20, 2025, for further filing guidance.
- Non-Employer Group (NEG) filings are required to use Filing Type "Group Policy Forms - NEG". This Filing Type is required in filings where any use of a non-employer group is possible. Please review FIN 2025-1 and Weekly Tip dated November 6, 2025, for further filing guidance.
