Amendment Tips
This week's tip gives guidance adjacent to submitting amendments in the new SERFF platform. Filers with active filings in the new platform have undoubtedly noticed there is new functionality for issuing and responding to compliance issues. Please keep in mind, functionality is being enhanced by the SERFF Team, so these are some perennial pointers.
Where do I attach a redline version of a filing document to show how it has been updated/revised?
• Redlines are not required. In most cases, the Compact reviewer uses document compare functionality and does not rely on filer redlines to understand updates.
• It is always helpful for the Filing Description to indicate features or provisions that vary from previously approved versions.
• If submitted, a redline of a form or other required attachment (such as Statement of Variability) in a filing should be provided as a separate line item under the Additional Supporting Documents tab.
• Redline versions of a form or other required documents are not marked approved upon disposition because they are in the nature of a draft. As a result, they should be separated from the material undergoing review.
Should I notify the reviewer I submitted an amendment?
• Do not notify the reviewer separately when a response to a compliance issue is submitted.
• You may notify the reviewer via Filing Note about an unsolicited voluntary amendment to explain why the voluntary amendment was submitted.
• While the new platform is less familiar to users at this point, there is no need to contact the reviewer outside of SERFF to duplicate a notice already occurring in the new platform.
