Arizona Participating in Long-Term Care Insurance Uniform Standards - Beginning September 26, 2025

The Interstate Insurance Product Regulation Commission (Compact) is pleased to announce that starting September 26th, Arizona will be participating in the individual long-term care insurance (iLTC) Uniform Standards. Arizona lifted its opt-out from the iLTC Uniform Standards by enacting legislation to amend its Compact statute. Arizona opted out of the iLTC Uniform Standards upon joining the Compact in 2014. Because the opt-out has been lifted, Arizona will now be available for inclusion in any new iLTC filing or previously approved iLTC filing for a product currently being marketed.

What does this mean for LTC filers authorized to do business in Arizona?

Starting September 26th, Arizona can be:

  1. Included in new iLTC product submissions (policies or riders with rates), as well as applications, outlines of coverage, advertising material and ancillary form filings for use with new Compact iLTC products.
  2. Added to pending and previously approved Compact iLTC product submissions (policies or riders with rates) that are currently being marketed, as well as applications, outlines of coverage, advertising material and ancillary form filings for use with previously approved Compact iLTC product submissions that are currently being marketed.

How can Arizona be added to iLTC products and forms?

  • Annual Registration: A company must be currently registered with the Insurance Compact to add Arizona to an eligible “Closed-Approved” iLTC filing. If your company is not registered for 2025, and you wish to add Arizona to an eligible iLTC filing, you must first submit a registration filing at the Update Only level. Once registered, you may add Arizona to an eligible “Closed-Approved” iLTC filing.
  • Add State: Consult the SERFF Industry User Manual for instructions on adding a state to a draft, submitted or Closed-Approved filing. Adding a state creates a voluntary amendment subject to approval by the Compact Office.
  • Filing Fees: Arizona does not collect filing fees for iLTC submissions. There are no Insurance Compact filing fees for adding Arizona to a filing submission.
  • Currently Marketed: To validate eligibility under Item 2 above, the filer will add a comment to the Change Description section of the voluntary amendment stating that the iLTC product is currently marketed.
  • For iLTC products subject to the Annual Rate Certification requirement in Section 3 of the Rate Filing Standards for Individual Long-Term Care Insurance (IIPRC-LTC-I-3-RATEI), the Compact Office will verify the marketing status based on the Annual Rate Certification submitted in 2025.
  • If the marketing status of the iLTC product is not supplied with the voluntary amendment to add the state, the addition of Arizona will be delayed until the filer provides the requested information.
  • Statement of Intent: The iLTC Uniform Standards do not permit mix and match of components of an iLTC product, so there is generally no need to update the Statement of Intent when Arizona is added, unless the Compact iLTC product was approved for use with a state life insurance policy or annuity contract. The Statement of Intent may be updated without the filing being reopened, if the iLTC filing already utilizes mix and match.
  • Approval of Added State: The Compact Office will review the amendment to add Arizona, approval of which can be found in the Amendment History for the Companies & States component of the filing. The service level for Compact action regarding an added state is one business day.
