Include States Carefully

The Insurance Compact is a vehicle that permits company filers to file a single submission for review and approval in up to 48 states depending on the product line. Why up to and not all in? Companies may only include the states in which they are currently licensed to do business in the line of business being filed.

Working on obtaining a Certificate of Authority? No worries. Make your filing without that state as the Compact filing submissions are designed to allow companies to add states at any point in time after the initial submission.

 Not sure if the company is authorized for a particular line of business? No worries. Make the filing without the state and add the state after you have confirmed authorization is in place.

Review of a filing is not delayed if the selection of states is incomplete. Our recommendation is to be conservative and include fewer states upon submission. Adding further states as questions are resolved does not affect the form or actuarial review. On the other hand, resolving the inclusion of states where the company lacks requisite authority will delay movement of a filing into the review queue. Which side of this issue do you want to be on?
